Reasons for the wheel clamp

Your vehicle was fined on numerous occasions in a zone where paid parking applies, or in a blue zone.

At the time that the parking attendant inspected your vehicle:

• No valid parking ticket was clearly visible behind the windscreen of the relevant vehicle or,
• No valid parking disc was clearly visible behind the windscreen of the relevant vehicle or,
• The vehicle was parked for longer than the allowed time.

Under the conditions indicated on the parking machines or the regulations on the use of the parking disc in blue zones, you are considered to opt for rate 1.

To date, we have not received any payments for the outstanding fines. The details of the outstanding fines were placed behind your windscreen wipers at the time when the wheel clamp was attached.

You can take your proof of payment to the Menen police station (open 24/24 7/7 - Leopoldplein 12, 8930 Menen) or you can mail a scan of your proof of payment to info@removeclamp.eu (Mo-Fri: 9h00 to 16h00).

LEGAL CONTEXT

• Considering the Belgian Act on road traffic policing, coordinated on 16-03-1968, article 1, paragraph 1 and article 54b, introduced by law on 20-07-2005;
• Considering the Belgian Royal Decree of 05-06-2013 amending the Royal Decree of 01-12-1975 on the General regulations for road traffic policing and on the use of the open road, (Belgian Bulletin of Acts, Orders and Decrees 28-06-2013), and specifically article 27e on the ‘use of the wheel clamp’
• Considering that art 27e of the Belgian Royal Decree dated 01-12-1975 on the General regulations for road traffic policing and on using the public road, provides that with failure to comply with the provisions of articles 27.1.1 27.1.2 27.1.4, 27.2, 27.3, 27c, and 27d, the vehicle can be immobilized with a wheel clamp.
• Whereas Cities and Municipalities are authorized to use the wheel clamp as injunctive relief in order to collect parking fines levied by them and payable to them, and the existing fine regulations apply in adapted form to enable the use of the wheel clamp and to determine its practical modalities.

Only in case of violations of the following provisions of the Road Code (RD 01-12-1975):

• Article 27.1.1, 27.1.2 (the use of the parking disk when parking in a blue zone) and the possible exemption of the use of this disc with a municipal parking ticket (Art 27.1.4 Road Code);
• Article 27.2 (the use of the parking disk when parking on parking lots on which a blue zone regulation is in force);
• Art 27.3 (parking in paying parking lots);
• Art 27c (parking in places reserved for the holders of an appropriate parking ticket);
• Art 27d (parking where the municipal parking ticket is replaced by electronic surveillance);

Can the parked vehicle be immobilized with a wheel clamp to recover payment of the fine(s) levied on the parking by the City.
